1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Flawless Palms Landscaping LLC ("Flawless Palms," "we," "us," or "our"), governing your use of our website at flawlesspalms.com (the "Site") and the landscaping, lawn care, and related services we provide (collectively, the "Services").
By accessing our Site, submitting a quote request, or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
2. Services Offered
Flawless Palms provides professional outdoor services in Sarasota, Manatee, and Charlotte counties, Florida, including but not limited to:
- Lawn mowing and maintenance (weekly and bi-weekly)
- Palm tree trimming, pruning, and planting
- Landscape design and installation
- Hedge and shrub trimming and shaping
- Mulching and decorative bed installation
- Sod installation (St. Augustine, Floratam, Bahia)
- Yard cleanups and debris removal
- Weed control and fertilization
The specific scope of services, pricing, and schedule for your property will be defined in a written estimate or service agreement provided to you prior to commencement of work.
3. Estimates and Quotes
All estimates provided by Flawless Palms — whether in person, by phone, by email, or through our website contact form — are valid for thirty (30) days from the date of issue unless otherwise stated. Estimates are based on the information available at the time of assessment and are subject to change if site conditions differ materially from what was represented.
A written estimate does not constitute a binding contract. Work will not commence until both parties have agreed to the scope and pricing, either verbally or in writing.
4. Scheduling and Access
You agree to provide Flawless Palms and its crew with reasonable access to your property on the scheduled service day(s). Our standard service hours are Monday through Saturday, 7:00 AM – 6:00 PM. We will make reasonable efforts to notify you of schedule changes due to weather or other circumstances beyond our control.
Flawless Palms is not liable for delays caused by inaccessible property, locked gates, pets loose in the yard, vehicles blocking the work area, or other conditions that prevent safe and efficient completion of the scheduled work.
5. Payment Terms
Payment terms will be specified in your estimate or service agreement. Unless otherwise agreed in writing:
- Recurring services (e.g., weekly mowing): Payment is due upon completion of each service visit or per the billing cycle specified in your service agreement.
- One-time or project services: A deposit may be required prior to commencement of work, with the balance due upon completion.
- Large landscaping projects: A payment schedule (e.g., 50% deposit, 50% upon completion) will be outlined in the written proposal.
Accepted payment methods include cash, check, and electronic payment methods as communicated by Flawless Palms. Invoices not paid within fifteen (15) days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance.
Flawless Palms reserves the right to suspend or discontinue services for accounts with outstanding unpaid balances.
6. Cancellations and Rescheduling
Recurring services: You may cancel or pause recurring services at any time by providing at least five (5) business days' written or verbal notice prior to the next scheduled service date. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee equal to the cost of one standard service visit.
Project or one-time services: If you cancel a scheduled project after a deposit has been paid, the following applies:
- Cancellation more than 5 business days before the scheduled start: Full deposit refunded.
- Cancellation 2–5 business days before the scheduled start: 50% of deposit refunded.
- Cancellation less than 48 hours before the scheduled start: Deposit is non-refundable.
Weather: Services may be rescheduled due to unsafe weather conditions (lightning, heavy rain, tropical storm warnings). No cancellation fee applies in these cases, and we will reschedule at the earliest available time.
7. Service Guarantee and Satisfaction
Flawless Palms takes pride in the quality of our work. If you are unsatisfied with any service performed, please contact us within 48 hours of service completion and we will return to address the issue at no additional charge. This guarantee applies to workmanship and does not cover pre-existing conditions, damage caused by weather or third parties, or conditions outside the agreed scope of work.
8. Property Conditions and Customer Responsibilities
You are responsible for:
- Informing Flawless Palms of any underground utilities, irrigation lines, or buried hazards prior to any digging or installation work.
- Ensuring pets are secured indoors or away from the work area on service days.
- Removing personal items (furniture, toys, hoses, vehicles) from work areas before scheduled service.
- Notifying us of any HOA restrictions, easements, or deed restrictions that may affect landscape work.
Flawless Palms is not liable for damage to unmarked or undisclosed underground utilities, irrigation systems, or other hidden property elements.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Flawless Palms Landscaping LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our Services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to the Services shall not exceed the total amount paid by you to Flawless Palms in the six (6) months preceding the claim.
Flawless Palms maintains general liability insurance. Proof of insurance is available upon request.
10. Intellectual Property
All content on this Site — including text, images, logos, graphics, and design elements — is the property of Flawless Palms Landscaping LLC or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our prior written permission.
11. Use of Site
You agree not to use the Site to:
- Transmit spam, unsolicited emails, or commercial solicitations
- Engage in any activity that disrupts or interferes with the Site's operation
- Attempt to gain unauthorized access to any portion of the Site
- Use automated tools to scrape or harvest data from the Site
- Violate any applicable federal, state, or local law or regulation
12. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Manatee County, Florida.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of our Site or Services after any changes constitutes your acceptance of the revised Terms.
